This agreement sets forth the legally binding terms and conditions for your use of the website at www.Croutique.com (the “site” or “website” or “Croutique”) and all services provided on the site.

Definitions and Notification of Changes

By using the Croutique.com website (the “site” or “Croutique”) and all sub-domains, which are a service of Expat Web Services FZ LLC., you are agreeing to be bound by the following terms and conditions (the “Terms of Use” or “The Agreement” or “User Agreement”).

Croutique may change these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made by the site. Your continued use of Croutique.com after changes are posted means you agree to be legally bound by these terms as updated and/or amended.

General Terms

The Croutique.com website is an online marketplace to buy and sell handmade and boutique items. When an item is purchased on the website, the order is placed with the seller of the product and not Croutique. Croutique takes the order and collects the payment through a third party payment gateway as the agent of the seller and not on our own behalf.

In addition, Croutique can in some cases arrange shipping through a third party courier service that collects the item from the seller and delivers it to the buyer. Upon the sale of an item, the contract is formed between the buyer and the seller directly.

Croutique has no control over the quality, safety, morality or legality of any aspect of the items listed, the truth or accuracy of the listings, the ability of sellers to sell the item or the ability of buyers to pay for items. Croutique sometimes pre-screens users or the content or information provided by users, but is not obligated to. Croutique cannot ensure that a buyer or seller will actually complete a transaction.

You agree that Croutique is a marketplace and as such is not responsible or liable for any content, for example, data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links posted by you, other users, or outside parties on Croutique.

You agree that we may communicate with you electronically for all aspects of your use of this website, including sending you electronic notices or by posting notices on the site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Images uploaded to the website may be used by Croutique for the purpose of promoting the website, promoting sellers and items and any public relations and marketing related activities and in this respect you grant us the license to use images you/ sellers upload on the website for our promotional material, social media channels and blog.

Croutique reserves the right to alter or terminate its services and to refuse service to anyone for any reason at any time.

With effect from 1st January 2018 all prices include VAT where applicable.

General Guidelines

You must be 18 years of age or older or you will not be able to enter into a legally binding contract to buy or sell via Croutique.

You must not use Croutique for any illegal or unauthorized purpose and you agree to comply with all UAE laws regarding online conduct and acceptable content such as libel law and must comply with all local jurisdiction.

You must not breach any laws, sell any counterfeit items or otherwise infringe the copyright, trade mark or other rights of third parties.

You must not threaten, intimidate, harass or otherwise abuse any other Croutique user.

You are responsible for maintaining that the content you submit is your own and is not owned by others.

You are solely responsible for your behaviour and conduct on Croutique including use of all content and data including images [graphics and photos], audio and video clips, links and text [such as conversations] that you post to the Croutique website.

You must not modify or adapt or ‘hack’ Croutique.com or seek to create another website or communication to users that implies it is associated to Croutique.com

You must not produce unwanted communications [spam] to other users of Croutique.

You are responsible for keeping your password secure.

You must not transmit or seek to transmit any viruses or worms or any code that seeks to alter the behaviour of the Croutique site or that is in any way destructive.

Seller Guidelines

Sellers must not list prohibited items – for a list of such items please refer to our Sellers FAQ for our policy on what is not allowed for sale.

Croutique reserves the right to change this list at any time and without notice.

Seller’s content and items must be your own original work which you have the right to make available and is not defamatory, does not infringe any law and indemnify Croutique against all legal fees, damages and other expenses that may be incurred by Croutique as a result of your breach of the above warranty.

Sellers must be legally entitled to sell the item listed for sale on Croutique. You must hold the intellectual property rights for any text and images you include in your listings.

Sellers must not list contact details, including your website address, email address and phone number, within listings, or in your seller profile or in messages sent through Croutique mail.

Sellers must possess the items listed in their shops. In case the item is no longer available with the seller, the listing must be removed.

Sellers must accurately and truthfully describe the items listed in their shops.

Sellers must choose appropriate categories for their items.

Sellers must provide accurate personal information such as names, addresses, contact details and telephone numbers. This information will be used by Croutique to arrange shipping of an item through a third party courier service. This information may also be used by Croutique to contact sellers for any verification purposes.

Unless otherwise specified in the description of the item or in case of customization of item, Croutique recommends that sellers be ready to ship items within 5 days of purchase of an item.

Sellers are responsible for appropriately packing their items to ensure that it is received by buyers safely and in good condition.

Sellers are responsible for accurately inputting weight of their packaged items at the time of listing. Accurate weights are necessary to calculate shipping charges. Overweighted or underweighted items might result in inaccurate shipping charges to buyers. Any expenses incurred due to inaccurate weight reporting will be borne by sellers.

Sellers are responsible for accurately filling in airways bills to facilitate shipping with the information Croutique provides in the event of a sale.

Sellers that do not have their items ready for delivery after a period of time, as deemed reasonable by Croutique, and hence cannot complete a sale after a buyer has made the payment will be blacklisted by Croutique. Any losses or expenses incurred in case a seller fails to complete a sale will be borne by the seller.

Sellers should ensure that when a purchase is made, correct items for ready for shipping. If it is found that wrong items or broken items or items drastically different from what is described in the item’s listing have been shipped from the seller to a buyer, then the seller has a chance to work with Croutique to ensure that the situation is corrected and the buyer receives the right items. Any expenses occurred in this process will be borne by the seller.

Due to the regulations in the UAE we will not be selling edible products meant for humans.

You must be a resident of the UAE to run a Croutique store.

Croutique reserves the right to terminate the membership of any seller who fails to adhere to the above guidelines and to remove any listing that is deemed inappropriate for the website.

Buyer Guidelines

Buyers purchasing items on Croutique must have the legal right to do so. This restricts membership to those of 18 years of age or over.

Buyers must ensure that correct contact details and shipping addresses are specified when buying an item on Croutique.

If a buyer receives a wrong item, broken item or an item that drastically differs from the image and description in its listing, please inform us so we can correct the situation.

Buyers are responsible for any expenses incurred as customs duties and taxes over the shipping charge.

Buyers must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase items from Croutique. The importation or exportation of certain items to a buyer may be prohibited by certain laws. Croutique makes no representation and accepts no liability in respect of the export or import of goods listed on the website.

Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE.

United Arab of Emirates is our country of domicile.

Minors under the age of 18 shall are prohibited to register as a User of this website and are not allowed to transact or use the website.

If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection.

The cardholder must retain a copy of transaction records and Merchant policies and rules.

Croutique Returns Policy

Each store on Croutique has its own refund policies about returns and exchanges. Please check on the store page to find out what their policies are.

Returns or refunds are not offered due to change of mind.

For hygienic reasons, no returns are allowed for earrings, swimwear or any intimate clothing.

Returns, refunds or exchanges are not possible in cases of custom made or personalized items.

Croutique will only consider items purchased for return if:

1. The item received is damaged

2. An item other than ordered has been received

3. The item differs majorly from the images and description in its listing. If you feel that the item you have purchased is not as described in its listing, please contact us.

Faulty or Incorrect Items

You must notify the seller within 48 hours of receipt of the goods of any faults or incorrect item received through the Croutique messaging system.

The seller will offer a replacement or exchange on the item.

If this is not possible, Croutique will issue store credit or a refund for the net value of the goods.

Refunds will be done only through the Original Mode of Payment.

The goods must be returned to the seller in their original condition with all labels and packaging intact, within 7 days of receipt.

Do bear in mind that as a lot of the items for sale on this website are handmade slight variations and imperfections may be present but not constitute a fault.

Out of Stock

If the goods you have purchased are not available or out of stock a refund or store credit to the same value will be offered.

Once you have accepted delivery of the goods ordered through this website you become the owner of them at your own risk. Croutique and the sellers are not liable for their destruction or loss after this point.

Croutique Messaging System and Website Commenting

Croutique Messaging System is the in-built messaging system within the website. Buyers and sellers must communicate through Croutique Messaging System on item purchases.

Croutique reserves the right to monitor all communication undertaken through Croutique Messaging System and all comments made on the website and blog.

Communication through Croutique Messaging System, comments or feedback must not contain offensive, defamatory or inappropriate language.

Croutique Messaging System must not be used to solicit any new business or arrange a transaction outside the website and this would be considered fee avoidance.

Croutique is not responsible for any of the opinions expressed in Croutique Messaging System or feedback posted on the website or social media and members have full legal responsibility and liability for their comments.


Croutique is not a shipping company and is not liable for shipping and must be organised by the seller. Unpon a purchased item, seller must package item appropriately and arrange delivery in a responsible and timely manner.

In the case of a returning item, seller must inform Croutique before processing the pickup of the item. Seller must inform Croutique for the reasons behind the returning item, Croutique will then confirm if item is suitable for a refund and return.

Organising a return of the product is the sellers responsibly, Croutique is responsible for the refunded transaction process.

Please be aware that certain items are prohibited from shipping and will not be transported by a courier service:

  • Dangerous goods
  • Firearms
  • Hazardous materials
  • Fur
  • Plants
  • Live animals
  • Ivory
  • Poisonous articles
  • Perishables
  • Alcoholic beverages
  • Liquids and semi-liquids
  • Negotiable bonds and drafts

Croutique will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE”.

Multiple shipments/delivery may result in multiple postings to the cardholder’s monthly statement.


Croutique will not sell or disclose your personal information to third parties without your explicit consent. We take reasonable measures (physical, organisational and technological) to safeguard against unauthorized access to your personally identifiable information and to safely store your personally identifiable information.

Users agree that Croutique may process your personal information that you provide to it for the purposes of providing our services and for sending marketing communications to you. Please read about our practices on Privacy listed on the website for detailed information.

Intellectual Property

All content included on Croutique, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software, is the property and copyright work of either Croutique.com, its users, its content suppliers or its licensors and is protected by copyright, trademarks, patents or other intellectual property rights and laws. The compilation of the content on the site is the exclusive property and copyright of Croutique.com and is protected by copyright, trademarks, patents or other intellectual property rights and laws.


You agree to indemnify and hold Croutique and its affiliates, officers, employees, agents and suppliers harmless from any and all claims, demands, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses), howsoever suffered or incurred due to or arising out of your breach of this User Agreement, or your violation of any law or the rights of a third party.

No Warranty

Croutique provides the website and its services on an "as is" and "as available" basis without any representation or endorsement made and without any warranty or guarantee of any kind whether express or implied, including but not limited to warranties of title, merchantability, fitness for a particular purpose, compatibility, security, accuracy and non-infringement.

Croutique makes no representations or warranties about the accuracy, reliability, or completeness of any content, information, software, text, graphics, links or communications provided on or through the use of the Site or that the operation of the site will be error free and/or uninterrupted.

Croutique makes no warranty that defects will be corrected or that the site or its servers are free of viruses or anything else which may be harmful or destructive. The nature of Internet communications means that this site may be susceptible to data corruption, interception, non-availability and delays. The website may also be unavailable from time to time due to repairs, maintenance or development work. You agree that Croutique has no obligation to provide support for the Site. You expressly agree that you use Croutique at your own risk.

Limitation of Liabilities

To the extent permitted by law, Croutique, its officers, employees, agents, affiliates and suppliers shall not be liable for any loss or damage whatsoever whether direct, indirect, incidental, special, consequential or exemplary, including but not limited to, losses or damages for loss of profits, goodwill, business, opportunity, data or other intangible losses arising out of or in connection with your use of the website, its services or this User Agreement (however arising, including negligence or otherwise and whether or not Croutique has been advised of the possibility of such losses or damages).

If you are dissatisfied with the website or any content or materials on it, your sole exclusive remedy is to discontinue your use of it. Further, you agree that any unauthorised use of the site and its services as a result of your negligent act or omission would result in irreparable injury to Croutique and Croutique shall treat any such unauthorised use as subject to the terms and conditions of this User Agreement.

Dispute Resolution

Should a dispute, claim, controversy or difference (including in relation to any tortious or statutory claim) occur between any user and Croutique, arising out of or in connection with these terms of use, including any question regarding its existence, validity or termination then the parties shall first attempt amicably to settle the Dispute through good-faith negotiations over a period of thirty (30) calendar days commencing on the date that a party first sends to the other party a written notice of the Dispute.

In the event that a Dispute has not been settled amicably by the relevant parties by the end of such thirty (30) calendar day-period, the parties hereby agree that the Dispute shall be referred to and finally resolved by binding arbitration by one (1) arbitrator in accordance with the rules of the Dubai International Arbitration Centre (DIAC). The seat or legal place of the arbitration shall be Dubai Arbitration Centre in Dubai, UAE. The arbitration proceedings shall be conducted in the English language and the award shall be in English.

The foregoing provisions of this clause are without prejudice to the right of Croutique to seek interim relief at any time from any court of competent jurisdiction (whether or not an arbitrator has been appointed) and Croutique shall not be deemed to have breached this arbitration agreement or infringed the powers of the arbitrator for having done so.

Governing Law

This User Agreement is governed by, and construed in accordance with, UAE law. This clause will survive any expiry or cancellation of this User Agreement for any reason.


If you break the above terms then your account will be suspended and possibly terminated. Croutique seeks to promote legal activity and well behaved conduct on its site however, you understand and agree in using the site that Croutique is a ‘place’ and is not responsible for the content posted on the site and that you may be exposed to content and behaviour that contravenes the above Terms and as such you use the Croutique service at your own risk.

All Croutique sellers are responsible for following all the laws that apply to them, their store and their goods, including copyright and shipping restrictions for goods.

Sellers are responsible for settling any fees or charges with 3rd parties, including insurance, duties, taxes, postage and couriers, unless using the pre- loaded Fetchr options.

Croutique reserves the right to remove any listings or images that are deemed inappropriate or offensive.
